Please read these Terms and conditions carefully as this contains important information regarding your legal rights, remedies and obligations. By accessing or using the Local Buddie Platform, you are agreeing to these Student Terms and Conditions  and concluding a legally binding contract with Meshi Webtech consultants Australia Pty Limited and/or its affiliates and/or it partners (hereinafter collectively referred to as "Local Buddie"). . If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior written agreements with you (If any).

 

These  Terms and Conditions (“Terms and Conditions”) constitute a legally binding agreement between you and Meshi Webtech Consultant Australia Pty limited  (an Australian company, ACN 617 889 362)  (we, our, us or Local Buddie ), By accessing or using the Local Buddie website (the "Site"), our mobile, tablet and other smart device applications, and application program interfaces (collectively, "Application") and all associated services (collectively, "Local Buddie Services"). The Site, Application and Local Buddie Services together are hereinafter collectively referred to as the “Local Buddie Platform”. You agree that you are responsible for reviewing these Terms and Conditions and our policies and requirements regularly, and your continued use of the Local Buddie Platform constitutes your acceptance of any modifications, changes, or revisions of these Terms and Conditions, policies and requirements.

In order to use the Services, you must first agree to the Terms. You can accept the Terms by:

A)    Clicking to accept or agree to the Terms, where it is made available to you by Local Buddie during the sign up process and/or anywhere in the Website/Application/Service,  and in the user interface for any particular Service; or

B)    Actually using the Services. In this case, you understand and agree that Local Buddie will treat your use of the Services as acceptance of the Terms from that point onwards.

These Terms and Conditions are in addition to any other terms and conditions, rules and regulations that may apply to accounts you have with Local Buddie or to any other services or information provided by Local Buddie. Where appropriate, please review those specific terms.

Submission of any forms via the Local Buddie Platform does not automatically qualify you for a package (Even if you had made the package purchase and paid in full). Any requests or submitted applications to purchase package are subject to review and approval by and at the discretion of Local Buddie.

Local Buddie may vary or amend or change or update these Terms entirely at its own discretion from time to time . You shall be responsible for checking these Terms from time to time and ensure continued compliance with these Terms. Your use of Local Buddie Platform after any such amendment or change in the Terms shall be deemed as your express acceptance to such amended/changed terms and you also agree to be bound by such changed/amended Terms.

 

Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the terms for the purposes of the applicable Services. Supplemental terms shall prevail over these terms in the event of a conflict with respect to the applicable Services.

 

Local Buddie will provide you with no written notice in the event of a material change to any terms, policies or supplemental terms that detrimentally affects your rights under these terms. Amendments will be effective upon Local Buddie’s posting of such updated terms at this location, the amended policies or supplemental terms on the applicable Service. It is your responsibility to review the terms and conditions for any changes and you are encouraged to check the Terms and conditions frequently. Your use of the Local Buddie Platform following the date of the amendments to the terms and conditions take effect will signify your assent to and acceptance of any revised Terms of Use. If you do not agree to abide by these or any future terms and conditions, please do not use or access the Website and Local Buddie Platform.

 

At its sole Discretion , Local Buddie may or may not provide the translation of the English version of the Terms into other languages. You understand and agree that any translation of the terms into other languages is only for your convenience and that the English version shall govern the terms of your relationship with Local Buddie. Furthermore, if there are any inconsistencies between the English version of the Terms and its translated version, the English version of the Terms shall prevail over others.

 

These terms and conditions shall also be fully applicable on the Student’s Parent and/or Student Guardian whose details are provided by the student during the sign up process with Local Buddie.

 

These terms and conditions shall also be fully applicable on the Student’s Parent and/or Student Guardian accompanying the student in Australia and had purchased Guardian Package from Local buddie. Detailed terms on the guardian package is mentioned in this Student terms and Conditions.

1.       Definitions

“Local Buddie Home” refers to a home and/or accommodation ( either leased , rented or owned by Local buddie)  which will accommodate students during the term of the purchased package.

“Accommodation(s)” refers to a private or shared (if applicable) furnished bedroom inside a Local Buddie home. Accommodation can be a spare room in apartment, house, condo, townhouse or any other type of housing available and accepted by Local Buddie.

“Content” means Local Buddie Content and User Content.

“Package” refers to the Local Buddie package consist of services offered by Local Buddie.

“Package Booking” means a confirmed accommodation along with list of other services offered by Local Buddie in the package. Packages are subject to review and approval by and at the discretion of Local Buddie.

“Student” refers to the person who has got admission in any of the Australian university, school or college and had purchased Local Buddie package. Also referred as user in this term and conditions.

“Local Buddie Platform” refers to Local Buddie website (the "Site"), our mobile, tablet and other smart device applications, and application program interfaces (collectively, "Application") and all associated services (collectively, "Local Buddie Services")

“Local Buddie Dashboard” refer to the Student Service management software which is  an information management tool that tracks all services of Local Buddie, display student’s information, package information along with other information which is required to be provided by local buddie to the student.

“Local Buddie Content” means content that Local Buddie itself makes available on or through the Local Buddie Platform, including proprietary Local Buddie content and any content licensed or authorized for use by or through Local Buddie from a third party, excluding User Content.

“Local Buddie Manager” refers to a person who will be single point of contact for each student and will be available at reasonable times to assist student’s and answer any queries of Students.

“User” refers to Students, Local Buddie Manager , Agent and any other user of the Local Buddie Platform.

“Agent” refers to the individual and/or company who represent students at Local buddie Platform. Also referred as user in this term and conditions.

“Agent Code” refer to the promotional code of the agent which may get package discounts to the student.

“User Content” refers to any information, descriptions, Reviews, photographs, applications, notifications, messages, or emails which are posted, listed, updated, displayed, sent, or shared on the Local Buddie Platform by Users.

“Student Parent/ Guardian” refer to the person , at least 18 years old or above the age of legal majority in Australia , whose details are provided by the student during the sign up process with Local Buddie as parent. Also referred as user in this term and conditions.

“Guardian Package” refers to the additional package purchased by the Student Parent/ Guardian , whose details are provided by the student during the sign up process with Local Buddie as parent.

As used in these Terms and Conditions, "you" or "your" or “Student(s)” refers to you or to any other person including your agent, you permit to use the Local Buddie Platform and Local Buddie Services on your behalf.

"We" “us” or "our" refers to Local Buddie or any designee, manager of Local Buddie.

“Including”, “includes” and the like mean “including, but not limited to”.

 

2.      Overview of Local Buddie Services

 

Local buddie was formed to make student‘s lives easier. Transparency and safety are at the top of our priority list. This is your all-inclusive, one-stop-shop for student housing and other requirements in Australia. We're here to ensure you have a positive living experience from start to finish. Our services for students continue far after the booking process is complete. 

 

We provide all forms of off-campus housing on a safe and user-friendly platform, with a personal Local Buddie Manager, who will be available to support you in need. With our mobile app, countless resources created specifically to improve your everyday experience with Local buddie in Australia.

 

Local Buddie package is designed for 15 days and includes below mentioned services/ features:

Important terms and conditions associated with above services/ features

 

A)   Pre-Arrival & Pre Travel Assistance – Pre-Arrival & Pre-Travel Assistance is a customized information (customized as per the need of an individual student) where local buddie will provide and coordinate resources, training, and assistance to prepare students for international travel viz. learn best practices for safe travel, know more about the city you are about to enter, Health & safety Advice, Pre departure Safety brief, Emergency protocols, international travel counselling, Q&A Sessions for both students & parents, Positive mindset training and much more. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service.

 

B)   Airport Pick up – At least 24 hours prior to Student’s departure, Student and his parent will get Airport pick details on student’s and parent’s Registered email and the same shall also be updated under the activity section of the Local Buddie dashboard. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service.

 

C)   Welcome Kit - Provision of welcome kit is our way of welcoming you to Australia. This Welcome kit shall be full of surprises and shall contain various necessary items for the student. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service.

 

D)   Comfortable Home Stay - At least 24 hours prior to Student’s departure, Student and his parent will get Home Stay details on student’s and parent’s registered email and the same shall also be updated under the activity section and student / parent profile section of the Local Buddie dashboard. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service.

 

E)    Sim Card & Unlimited Wi-Fi – Sim Card with a maximum value of $35 (approximately 2000 minutes of Zone1 & Zone 2 Calling - India comes under Zone 1) shall be provided to the student. Student can avail unlimited Wi- Fi Exclusively at HOME STAY only. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service. Cost of any additional usage of Phone & WIFI shall be borne by the student only.

 

 

F)    Food & Beverage – All Food & beverage shall be provided within the home stay only. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service. Local Buddie shall not be responsible for Food & beverage consumed by the student which is not provided by the Local Buddie. Cost of Such Food & Beverage shall be borne exclusively by student only.

 

G)   Travel Cards – To travel to and from the college by local transport, Local Buddie shall provide student with the Travel Card with the balance sufficient to travel to and from the home stay to college. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service. Any other travel cost of the student shall be borne exclusively by student only.

 

H)   Laundry - Laundry facilities will vary from Accommodation-to-Accommodation. For example, some Accommodations may have laundry facilities available within the accommodation, and in other Accommodations laundry may be part of a building complex. Local buddie may limit the use of laundry facilities to once or twice a week and set up a laundry schedule. Cost of any laundry done outside the knowledge of Local Buddie shall be borne exclusively by student only.

 

I)     College Travel Assistance - To travel to and from the college by local transport, Local Buddie shall provide student with the Travel Card with the balance sufficient to travel to and from the home stay to college. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service. Any other travel cost of the student shall be borne exclusively by student only.

 

J)     Bank Account Opening – Local Buddie shall provide assistance to all students in Bank Account opening however bank account opening process shall be done under the guidance of the BANK and its employees only. Student can choose any bank of their choice. Local Buddie will just act as a felicitator and all decision made by the student in respect of opening bank account shall be of student only. Local Buddie shall not be held responsible for any wrong decision taken by the student anytime during and after the term of this agreement. This service/ feature is the part of the package and no additional fees are charged by Local Buddie for this service.

 

 

K)   Emergency Financial Support- Financial assistance for unexpected emergencies is available through Local Buddie.  If you are facing an unexpected emergency, you can let your Local Buddie manager for emergency financial support. You can get help when: (i) a situation is caused by unforeseeable circumstances beyond your control, and (ii) it presents a severe health risk. This emergency financial support can cover costs for food, clothing, medical condition, transportation and any other situation approved by Local Buddie. Emergency financial support shall be provided only after the approval and written request by the parent of the student. Parent needs to repay the amount within 5 days from the time financial support is provided to the student. We support students on a human ground and does not levy any interest or other charges on such extended financial support. Whenever a student is in an emergency situation and need financial support, he/she shall need to get in touch with his/her Local Buddie Manager. The formal process shall be informed to the student and parent when the request is made by the student for emergency financial support.

 

L)    City Orientation & Full City Tour - University orientation is generally given by the universities which are aimed at familiarizing the students to an unknown campus environment, its faculties and infrastructure. However, very less institution prefers to provide students with the City Orientation or Full City Tour which is equally important when compared to University Orientation. Local Buddie provides students with city orientation programme which plays an important role in a student’s transition to a university life in a new city of Australia. It’s a day long Hop on Hop Off tour where a student can customize his/her own itinerary by simply hopping on and off at any of the multiple stops located in the city and surroundings including the popular city destinations. Students can enjoy audio commentary in multiple languages and take in gorgeous views of the city from open-top, double-decker buses and check out famous attractions of the city. Take in the 360° views on the top deck; perfect for photographing! Enjoy a flexible city tour as you can spend time at one attraction for as long as you want before hopping on the bus to go to your next destination. City orientation doesn’t get easier than this! City Orientation programmes are aimed at familiarizing the students to an unknown new city, its history and its local culture and it enables students to discover city’s popular attractions, bustling streets, food, art, fashion and more. It also helps students to adjust quickly with the vibe of the city. City orientation programme details shall be given to the student once they arrive in Australia. City Orientation or full city tour is part of Local Buddie package and Local buddie does not charge any additional fees for the same.

 

 

M)  Separate & Secure Female Accommodation & Dedicated Female Manager for Female Students- Choosing the best and safest mode of accommodation in a new country for the female student can be quite challenging for both parents and students. At Local Buddie, we understand that the need for the safe and secure accommodation for each female student is of paramount importance. To ensure the same, Local Buddie provides stand alone, Separate, safe and secure female accommodation with dedicated female manager for 24*7 assistance. Features (apart from existing package features) of Female Local Buddie home are: (i) Very close to university campus to provide hassle free travel, (ii) Located in a prime family residential area to ensure safety and convenience of female students, (iii) Dedicated female Local buddie manager for 24*7 Assistance, (iv) Dedicated travel assistance, (v) Strictly no male access allowed, (vi) Non-resident female members, female guests and female visitors are not permitted to remain on the premises after 09:00pm, (vii) Late arrivals ( after 10:00 pm ) is strictly not allowed unless and until approved by the Local buddie management or special permission received from the parents, (viii) Staying away overnight is strictly not allowed unless and until approved by the Local buddie management or special permission received from the parents, (ix)Vigilant security facilities are available round the clock

 

N)   Digital Safe / Lockers for Documents - To protect & store student’s important documents, we do provide digital locker at Local Buddie Home. Every Local Buddie home have one digital Locker which is operated exclusively by the Local Buddie Manager. Student can handover the documents they wish to keep it secure to the Local buddie Manager and Local buddie Manager will securely keep all such documents in the digital locker. Student will have to sign a document inventory register/form each time student is giving or taking the documents to/from the Local Buddie manager. Subject to the availability of the Local Buddie Manager, Student can access the lockers any time from 7 am to 10 pm during the term of the package. 

 

O)   Emergency Medical Assistance - All Students must have medical insurance while staying with Local Buddie. It is best for the student to have a print-out of their medical insurance policy and handover the copy of the same to the assigned LOCAL BUDDIE MANAGER as soon as they arrive at Local Buddie Home. In the event of medical emergency , Students are advised to contact the LOCAL BUDDIE MANAGER assigned to them or call ambulance service immediately. All medical emergency numbers are available at Local buddie Home .If Local Buddie Manager is present in the Local buddie Home during medical Emergency ,  student will be taken to the nearby clinic, or, if necessary, an ambulance will be called. If ambulance is not available or taking time to reach Local Buddie home, Local Buddie will pay the cost of taxi for transportation.  Students are often accompanied by Local Buddie manager or other Local Buddie staff, and updates are generally provided to the Local Buddie so that we can inform it to the parents.  All required follow-up will be communicated to the parents every day. If the condition of the student becomes critical (as advised by the doctors), parents are expected to join student as soon as possible. Payment for medical services (including transportation) is solely the student’s responsibility.

 

 

P)    Expert Advice on Licenses - Local Buddie will get you an expert advice on all your driving license needs during your stay with Local buddie. Driving is definitely important for every international student who arrive in Australia as driving can make getting around a lot easier and it makes life more comfortable if you live in an area where public transport might not be so frequent. International students are regarded as temporary residents, which means that you are able to drive in Australia using your licence from your home country as long as it is current and valid. If your licence is not written in English, you must also carry a certified translation in English or apply for an International Driving Permit from your home country. If you don’t have an overseas licence and want to apply for a licence in Australia, you will need to apply through your state or territory motor registry. It’s important to be aware that driving rules in Australia vary between states and territories, so make sure you learn the rules that apply to where you’re planning on driving.

 

Q)   Expert Advice on Visa Extensions - Student visa extensions or applying for any other visa to stay & work in Australia is an important decision of student’s life and expert advice can help students to understand the complexity of visa easily. Student visas doesn’t get extended automatically. To stay legally in Australia, you need to apply for student visa extension or any other visa, in case your current visa is expiring and your course has been extended. There are multiple type of visa’s students can apply, however the common ones are as follow- Student Visa Extension, Visitor Visa, Family Visit Visa, Temporary Resident Visa, Permanent Resident Visa. Our expert visa advisors are registered MARA agents and can guide students with expert legal advice and assistance in taking right VISA decisions with right and appropriate knowledge on available VISA and VISA updates.

 

R)   Expert Advice on Student Jobs - It is always advisable to have sufficient funds in your bank account for books, foods, housing, transportation, medical, phone bills, internet etc.  Student can always earn by working a part time job in Australia. Students are allowed to work up to 20 hours per week. Our expert advisors will guide each and every student on the following: What kinds of jobs are available for students in Australia? How can student find a suitable job in Australia? What is the hiring process of the student’s jobs in Australia? How much do student job pay in Australia? Moreover, our expert advisors will guide you on how to maintain a balance between work, college and free time, allowing you to enjoy the full experience of being an international student in Australia.

 

S)    Home Lease Support & Shifting support to your new home - In most of the cases, college is the first-time student will live away from their parents or family and to move into a right home is a crucial step in ensuring a successful college transition. Finding a place to live in Australia is an important step for students and Local Buddie extends all support in helping student find a home away from home. Our Local Buddie Home team provides the following services:

 

·      Assistance with your home search which includes property inspections

·      Choosing roommates

·      Support budgeting and planning your living costs

·      Documentation Support

·      Information about the leasing process

·      Other resources Like contracts and leases

·      Safety and fire prevention resources

·      Shifting student from Local Buddie home to new leased home and much more!

 

Local Buddie provides this service through an experienced home rental / local property advisor. Local buddie does not charge any additional fees for the above services. Students who wish to search home independently without Local Buddie support shall provide us with the declaration form clearly stating no support required from Local Buddie in renting home in Australia and ins this case, all the expenses attributed to home search shall be borne by the student only.  Declaration form is available with the Local Buddie manager. 

 

 

T)    Gala Dinner - Gala Dinner is our special dinner event, our own personalized way of giving farewell to the students and give them all luck to succeed in their future endeavors. Its full of surprises and involve many activities which will not only strengthen the bonds of friendship between the students but will also mark a night, which will create positive memories for years to come.

 

Important Information - Anything not mentioned above is not included in package therefore students will need to purchase these at their expense. Please make sure that you let us know at the time of booking the package, if you have any food allergies or special dietary requirements such as dairy-free, gluten-free, halal, vegan, vegetarian, nut-free, seafood-free etc so we can cater for your individual needs.

 

 

 

3.      Eligibility and Student Verification

 

3.1    The Local Buddie Platform is intended for users who are at least 18 years old. By accessing and using the Local Buddie Platform you represent and warrant that you are 18 or older or above the age of legal majority in Australia and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. If you are below 18 years of age or below the age of legal majority in your jurisdiction and/or Australia, you are required to provide Parent Consent form. Parent consent form will be made available at the sign up process.

3.2    Compliance with Laws. You are in compliance with all laws and regulations of Australia when you access and use the Services. You agree to use the Services only in compliance with these Terms and applicable law, and in a manner that does not violate our legal rights or those of any third party(ies).

 

Local Buddie may restrict you from accessing or using the full Services, or any part of them, immediately, without notice, in circumstances where Local Buddie reasonably suspects that:

 

(i)      you have, or are likely to, breach these Terms;

(ii)     and/or you do not, or are likely not to, qualify, under applicable law or the standards and policies of Local Buddie and its affiliates, to access and use the Services.

(iii)   or on 30 days' written notice to you, where Local Buddie, acting reasonably, terminates these Terms or any Services for any legitimate business, legal or regulatory reason.

3.3  Local Buddie reserves the right to verify your identity by requesting proof of identification (including, a valid Australian visa, local driver’s license or any other government issued identification number, and birth certificate, if applicable). You accept and authorize Local Buddie to use your personal information and documentation for background check purposes. Local Buddie may also obtain public records of criminal convictions or sex offenders registration or conduct equivalent background checks.

3.4  Local Buddie may ask you for documents which may be required by Local Buddie or any local authority for verification. If you do not provide the requested information within the time frame given by the Local Buddie , Local Buddie reserves the right to cancel all packages you have booked. The cancellation will be treated as a Student cancellation under the Student Cancellation Policy.

 

4        Privacy

 

Local Buddie collects and shares personal information about you in order to identify you as our customer, to establish and manage customer accounts, to complete customer transactions, to provide information to you about the Local Buddie Platform and Local Buddie Services, to comply with legal and regulatory requirements, and for other reasons. Our collection and use of personal information in connection with your access to and use of the Local Buddie Platform and Local Buddie Services is described in our Privacy Policy.

5        Sign up & Package booking Process & Requirements

 

5.1  Step 1 - As an unregistered user of the site, you will only be able to browse through our website without signing up but you will be required to provide us with the basic information such as name, gender, phone number, complete physical address, email address & password for future access to your Local Buddie account, and you will be asked to choose a package you are looking to purchase from Local Buddie. You will be bound by these Terms and Conditions even if you are not a registered user. As soon as you have completed this basic registration process, you will receive an email confirming your registration with Local Buddie. However, you still need to provide further information in order to access and use the Local Buddie Dashboard.

5.2  Step 2 - On completion of the basic registration process, you will be asked to provide us with an agent code (if you have one), Agent code can get you up to 50% discounts on the package rates. Get in touch with your education consultant or travel agent to get an agent code or you can chat with us or email us at support@localbuddie.com to get an agent code. Agent codes are subject to approval by your education consultant or travel agent. You will not be able to get any package discount if you skip this step.

5.3  Step 3 – Post providing us with the Agent code , you will instantly see the discounted price at this step. You need to provide us with payment of the package you are intending to purchase in accordance with payment clause no.6 of this student terms and conditions. On the successful completion of the package payment – you will be provided with the payment receipt on your registered email address within 24 hours from the receipt of the payment.

5.4  Step 4-  Once you have completed the payment – you will be required to provide us with your personal information such as Date of Birth, Parent consent form ( only if you are below 18 years of age), Identification proof’s like Aadhaar Card, Driver’s License, Passport, Food Preferences , Food allergies (if any) along with other details as required by Local Buddie.

5.5  Step 5- You are now directed to provide us with detailed information of your parent / guardian such as your relationship with your parent / guardian, full Name, gender, country code, phone number, email address & password for future access to parent/guardian Local Buddie account, Date of birth ( must be above 18 years of age), country, state, city , pin code and identification proof.

5.6  Step 6- You are now directed to provide us with your college details which includes you college name , College address , Study Course name and Confirmation of enrolment letter.

5.7  Step 7- You are now directed to provide us your travel dates and information along with your Visa and medical insurance details

5.8  Step 8-  This is an optional form. You can skip it if you want by just not filling any of the fields and click on Submit & Finish. If you wish , you can provide us with more documents , We can print and file these documents and provide you on your arrival . If you have even more relevant documents to share with us, you can email  such documents to us at support@localbuddie.com from your registered email address.

5.9  On finishing the step 8 – you will be re directed to the Local Buddie dashboard , where you will need to click on the email verification button to verify your registered email. Email verification is mandatory step for the package approval.

5.10     On your Local Buddie Dashboard and under package you will see the status – “Your Package is getting processed, we shall inform you once your package is ready.” We will process packages in the order they are submitted. We will only look at the documents that you had attached during the sign up process. If all your provided documents are correct and in order, we will send you a package approval email confirming the approval of the package with details of your Local Buddie manager and you can access the Local buddie dashboard for information on the package services. We may ask you more documents , if we find out that your documents are incorrect and/or not in the order. 

5.11     You shall register only one account with Local Buddie unless you receive our written authorization. You may not transfer your account to another user at any time. Local Buddie reserves the right to disable or suspend your account if you create more than one account, or if any of the information provided proves to be fraudulent, inaccurate, incorrect, incomplete, or if you are found in violation of these Terms and Conditions or any policies or requirements.

5.12     You are responsible for providing current, correct, full and accurate information throughout the registration process as well as for keeping your information up to date throughout your stay at any Local Buddie home or accommodation.

5.13     You are responsible for keeping your information safe and secure and may not disclose your Local buddie account access credentials to another party. You must inform Local Buddie immediately if you suspect that your Local Buddie account access credentials have been used without your knowledge.

5.14     There may be security, transmission or other risks associated with use of the Internet and online services and platforms, and you expressly assume any and all such risks. You are responsible for obtaining all software, hardware or other equipment necessary to use online services, including, without limitation, the use of up-to-date web-browsers and appropriate encryption, antivirus, anti-spyware, and Internet security software. The Site contains encryption methods that are not supported by all browsers. If you are not using a browser that supports 128-bit encryption, you may be unable to view all of the information and materials contained on the Site.

5.15     Under certain circumstances and for any reason necessary, Local Buddie reserves the right, in its sole discretion, to cancel or refuse the service, a Booking Request or a Booking made via the Local Buddie Platform. Local Buddie may also decide, in its sole discretion, to refund to the Student part or all of the amounts charged to the Student in accordance with the Student Cancellation Policy or in connection with a cancellation. You agree that Student Cancellation Policy will be free of any liability for such cancellations, refusals or refunds.

5.16     Local buddie has the right to pursue legal action for package fees and other compensation that are not paid when due by you.

 

6        Payments

 

6.1  All package price payment and other service payments (if any) are received and paid in AUD (Australian Dollars) only.

6.2  By signing up with Local buddie, you are expressly agreeing that Local buddie is authorized to charge you a package fee as per your selected package during sign up process , any other fees for additional services you may purchase, and any other charges including charges against the damages to the accommodation and any applicable taxes in connection with your use of the Service through credit or debit card, ("Payment Method") that you provided during sign up process.

6.3  You can also pay us the package cost in advance or at the time of sign up process via bank transfers. On the successful receipt of the payment in our bank accounts , Local buddie will provide you with the payment voucher code which can be redeemed during the sign up process against the package purchase price. You are responsible for the accuracy and authenticity of all such bank account transfers.

6.4  Local Buddie reserves the right to pursue any amounts you fail to pay in connection with the Service. You will remain liable to the Local Buddie for all such amounts and all costs incurred by the Local Buddie in connection with the collection of amounts mentioned in clause 6.2, including, without limitation any reasonable attorneys´ fees, and arbitration or court costs.

6.5  You also understand and acknowledge that the Local Buddie facilitates all credit and debit card payment through the third-party payment gateway ( “Stripe”) for processing of payment. This facility is managed by the third-party payment gateway provider and you are required to follow all the terms and conditions of such third party payment gateway provider. You are responsible for the accuracy and authenticity of the information provided by you, including the credit card/debit card details .You agree and acknowledge that the Local Buddie shall not be liable and in no way be held responsible for any losses whatsoever, whether direct, indirect, incidental or consequential, including without limitation any losses due to delay in processing of payment instruction or any credit card/debit card.

6.6  In cases of short charging of any amount including Package price and any other charges as per the clause no. 6.2 of this student terms and conditions owing to any technical error or other reason, Local buddie shall reserve the right to deduct, charge or claim the balance amount from the Student and the Student shall pay such balance amount to Local Buddie. In cases where the short charge is claimed prior to the utilization of the package, Local buddie will be at liberty to cancel such packages if the amount is not paid before the utilization date.

6.7  The student agrees and understands that all payments shall only be made to bank accounts of Local buddie . Local buddie or its agents, representatives or employees shall never ask a student to transfer money to any private account or to any account not held in the name of MESHI WEBTECH CONSULTANTS AUSTRALIA PTY LIMITED. The User agrees that if that user transfers any amount against any booking or transaction to any bank account that is not legitimately held by Local buddie or to any personal account of any person, Local buddie  shall not be held liable for the same. Student shall not hold any right to recover from Local buddie any amount which is transferred by the student to any third party.

6.8  The student will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords, voucher code etc. with any person including the agents, employees or representatives of Local buddie . The User shall immediately inform Local buddie  if such details are demanded by any of its agents employees or representatives. Local buddie  shall not be liable for any loss that the Student incurs for sharing the aforesaid details.

 

7        Parent/Guardian Package

 

If any parent / guardian of the student would like to accompany the student, can book an accommodation with Local buddie on the following conditions:

 

a)     all the terms and conditions of this term and condition shall be valid on Student’s parent/guardian.

b)     Supplementary terms shall be signed by Student’s parent/guardian, which shall be given to the Student’s parent/guardian at the time of package booking and/or package booking enquiry.

c)     Student Parent/Guardian can only book the package post approval of student package by Local buddie.

d)     For Parent/Guardian Package price and for any other details, please write an email to us at suport@localbuddie.com or chat with us through Local Buddie Platform.

 

 

 

8        Cancellations and Refunds

 

8.1  Students may cancel an unapproved package Booking Request or an approved package Booking on or before 15 days from the start date of the package. All cancellations must be made through the Local Buddie Platform. Cancellation submitted solely to your Local Buddie Manager will not be considered. Cancellation submitted Local Buddie via Emails , TEXT messages will not be considered. Your cancellation will be reviewed and determined by Local Buddie in accordance with the Student Cancellation Policy ( point no. 8.3). Interpretation and determination of available refunds or credits will be made by Local Buddie in its sole discretion. Local Buddie reserves the right to refuse and deny a refund or credit for any reason at any time. Any available refund will be promptly credited to your account for future use or returned to the same credit card within 21 days, as stated in the Student Cancellation Policy (point no. 8.3). Students are responsible to inform Local Buddie in case the credit card used is no longer valid. Local Buddie will not be responsible for any loss of funds due to an invalid card refund process.

8.2  In addition, Local buddie reserves the right to terminate without compensation a Student’s package Booking if the Student is found to have behaved with misconduct. Misconduct includes theft, abuse of property, verbal or physical abuse of persons, smoking inside the Accommodation, alcohol or drug use, failure to adhere to federal, state or local laws and regulations, and Local Buddie’s rules and guidelines as per these terms and conditions. In addition, Local Buddie may inform your advisor at the College you are attending. No refunds whatsoever will be paid to Students who have been found to have behaved with misconduct.

8.3  Student Cancellation Policy - This Student Cancellation Policy outlines the charges and refunds for Students when an unapproved package Booking Request or  approved package Booking is cancelled by the Student.  A reservation can be cancelled by logging into your Local Buddie Platform account.  Local Buddie will use reasonable efforts to resolve any dispute or problem between a Student and Local Buddie . Local Buddie has the final decision on all disputes, problems, charges and refunds, and Local Buddie decision will be binding on the Student. If you have any comments or questions about this Student Cancellation Policy, feel free to contact us via email at support@localbuddie.com. Student cannot alter/Modify/cancel the individual services of the package and are allowed to cancel the complete package. If student does not utilise any services of the package , no refund shall be applicable for the services not utilised by the Student.

8.4  Package Booking Change Policy - Students may request changes to a Package Booking through the Local Buddie Platform on or before 15 days from the start date of the package.. Changes may refer to dates, and meal plans. Any change request is subject to the Local Buddie’s approval. If Local Buddie accepts the request, the package booking will be changed and your payment will be updated accordingly. If the request is declined or Local Buddie does not respond, your confirmed booking remains unchanged.

 

9        Student privilege, limitations and obligations

 

When accessing the Local Buddie Accommodation, you will have certain privileges and limitations a Local buddie may offer. When you send a package Booking Request, you agree to these privileges and limitation, and you are required to respect them in accordance with these Terms and Conditions; otherwise, you agree your package Booking may be cancelled and the Student Cancellation Policy will apply.

  1. Local buddie Accommodation rules – Local buddie is entitled to impose certain house rules at the Accommodation. House rules may vary from Accommodation-to-Accommodation, and Students should review them on their arrival to local buddie accommodation.
  2. Personal Privacy – Students are entitled to personal privacy inside the Accommodation. However, Local buddie Manager and/or Local buddie employee may occasionally inspect the Student bedroom.
  3. Cleaning – Students are responsible for maintaining the bedroom clean and organized at all times. Students are also required to clean up after themselves in all other areas they use.
  4. Key – The Student will be provided with a key/key card to access the Accommodation premises by the Local buddie. The Student is responsible for keeping the key/key card safe at all times and return it to the Local Buddie prior to the move out date. In the event that the Student loses or fails to return the Local Buddie’s key/key card, it will be considered a Damage Case, and the Student will be responsible for paying costs of applicable locksmith services (see Section 10- Damages to Accommodation).
  5. Laundry access – Laundry facilities will vary from Accommodation-to-Accommodation. For example, some Accommodations may have laundry facilities available within the accommodation, and in other Accommodations laundry may be part of a building complex. Local buddie may limit the use of laundry facilities to once or twice a week and set up a laundry schedule.
  6. Kitchen access – Students will have access to some space in the kitchen to store food in the fridge and a cabinet designated by the Local Buddie. Kitchen access will vary from Accommodation-to-Accommodation. Students should be allowed to use all the appliances offered in the kitchen, however, certain kitchen rules imposed by the Local Buddie may apply. Local Buddie may place restrictions on times that kitchen usage is permitted and Students agreement to comply with these restrictions. Students are responsible for cleaning up after themselves when using the kitchen.
  7. Common areas – Students should have access to common areas such as living room, bathroom, kitchen. However, certain areas, such as other rooms or facilities may be restricted from access by Students at Local buddie’s sole discretion.

 

 

10     Damages to the Accommodation

 

10.1 As a Student, you are responsible for leaving the Accommodation & Local Buddie Home (including but not limited to any personal or other property located at the Accommodation) in the condition you found it when you arrived. Students are responsible for their own acts and omissions and are also responsible for the acts and omissions of any individuals whom they invite or provide with access to the Accommodation.

10.2 You acknowledge and accept that Local Buddie can and will charge you for any type of damage, including, but not limited to key and/or lock replacements, personal items left behind, and/or cleaning costs incurred by the Student.

10.3 Students will have 24 hours from the arrival to the Accommodation to report any damage that has been found at the Accommodation as of their move in date. Students should send their claim to support@localbuddie.com or inform in writing to Local Buddie Manager and include evidence of the damage, e.g., photos clearly showing the damage to the item or Accommodation. If such report has not been received within 24 hours of arrival, the Local Buddie will assume that the damage was made by the Student.

10.4 If the Local Buddie Manager claims and provides sufficient information and evidence (including, but not limited to photographs) that you have caused any type of damages to the Accommodation or any personal or other property at an Accommodation (“Damage Case”), the Local buddie can request payment from you or, if the matter cannot be resolved immediately between you and Local Buddie, you will have opportunity to respond. If you agree to pay, Local Buddie will collect appropriate amount from you and/or against your Damage Preauthorization (if applicable) required to cover the Damage Case in accordance with these Terms and Conditions. In addition, Local Buddie reserves the right to collect the payment from you and pursue any compensation due through any remedies available to Local Buddie, in regard to situations in which you are responsible for a Damage Case, including, but not limited to any payment the Local Buddie may request.

10.5 Students agree to cooperate with Local Buddie in good faith, and to provide sufficient evidence and information and take such actions as may be reasonably requested by Local Buddie in relation to any Damage Case or any other claims or complaints. In addition, as a Student, you understand and accept that Local buddie may make a claim under any of your insurance policies related to any damage or loss that you may have caused or been responsible for or to an Accommodation or any personal or other property located at an Accommodation. You also agree to provide information and cooperate with Local Buddie in order to make claim under your insurance policy.

10.6 As a Student you agree to participate in mediation or similar resolution process with Local Buddie, at no cost to you, which process will be conducted by Local Buddie with respect to damages for which the Local Buddie is requesting payment.

 

 

 

11     Reviews & Photos

To maintain quality of the Local Buddie Services, we encourage all Students to write an honest and fair review about their experience with their Accommodation (an “Accommodation Review”). After you have moved out from the Accommodation, you will receive an email requesting you to complete an Accommodation Review. Your review must be truthful, factual and may not contain any offensive or defamatory language. Your review may be posted on the Local Buddie Platform for other Users to view. Local Buddie also encourages Students to send us an email and provide comments at support@localbuddie.com and to share any photos a Student wishes to provide to Local Buddie. You agree that the Accommodation Reviews (including, but not limited to evaluations, comments, feedback, photographs, letters, emails, referrals, text messages) that you submit to Local Buddie will be considered User Content. Local Buddie may, at its sole discretion, publicly share any of the Accommodation Reviews provided to Local Buddie, including on the Site, Local Buddie Platform, social media accounts, review websites, and advertising campaigns.

 

12     Acceptable use Policy

 

Students are responsible and agree to be in compliance with any and all laws, rules, regulations and obligations that may apply when using the Local Buddie Platform and Local Buddie Services. As a Student, you agree that you will not violate any of the conditions mentioned in this clause ( Referred as Local Buddie acceptable use policy ). Local Buddie reserves the right to prosecute any breach or violation of any of the Local Buddie acceptable use policy to the entire extent of the law. You also accept that Local Buddie has the right to take a range of actions against you, including cancelling, removing, blocking, deactivating, and disabling the content of your account and your access to information and services on the Local Buddie Platform.

 

As a User/ Student / Student parent or guardian, you agree not to misuse the Local Buddie Platform or help anyone else do so. Below are some guidelines for what you should not do with the Local Buddie Platform. 

 

You agree that you will not:

  • Violate any local, state, provincial, national, federal, or any other law or regulation that may apply. In addition, you accept that you will not violate any court order;
  • Use any (manual or automated) processes, including, but not limited to software, scripts, devices, backdoors, robots to access, "scrape," "crawl" or "spider" on Local buddie as well as other websites, which may be posted on the Local buddie Platform;
  • Damage or interfere with the Local buddie Platform including, but not limited to the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, backdoors, packet or IP spoofing, forged routing or electronic mail address information, or any similar means of technology;
  • Use or access the Local buddie Platform to expose, use, or allow to be used, exposed any materials, content, functions, or services 1) that are not publicly displayed by Local buddie on any search result pages, listings before your package Booking Request is confirmed, 2) that are inconsistent with Local buddie services, policy, terms, conditions, 3) in any way that may violate any rights, including privacy, of any student and/or student Parent/ Guardian and/or user of Local buddie or its employees, vendors, partners, or any third party;
  • Use the Local buddie Platform for any purpose, including, but not limited to commercial, marketing, for profit or non-profit that are not permitted by these Terms and Conditions, or in a tone that may incorrectly imply Local buddie endorsement, partnership or otherwise misleading information and claims as to your relation to Local buddie;
  • Diminish, dilute, damage, hurt or otherwise harm the Local buddie brand in any way;
  • Use and/or register Local buddie or derivative terms in domain names, trade names, trademarks, logos or other source identifiers, or use or register domain names, trade names, trademarks, logos or other source identifiers that closely imitate or are confusingly similar to Local buddie domain names, trademarks, logos, taglines, promotional campaigns or Content;
  • Copy, store, use, access, share or distribute any information contained on the Local buddie Platform, including Content, for any purpose not described or permitted by these Terms and Conditions;
  • Violate or infringe the rights of Local buddie or/and all of its users, partners and third parties in any way including, but not limited to intellectual property, privacy, publicity or contractual right;
  • Use the Local buddie Platform to spread, transmit, distribute, share, post or submit any information concerning any other person or entity, including, but not limited to photographs, personal contact information, or credit, debit, calling card or account numbers without their consent;
  • Use the Local buddie Platform to distribute any unsolicited commercial email ("spam") or advertisement not connected with Local buddie Accommodation and services.
  • Promote, solicit or recruit any User to join any third-party services, websites, applications without Local buddie consent and approval;
  • Harass, intimidate, persecute, threaten or stalk any User, or to store or gather any personal information about any User through the Local buddie Platform;
  • Engage in harassing, abusive, disturbing, troublesome, prohibited behaviour in any aspect or use of the Local buddie Platform and Local buddie Services, or any Accommodation;
  • Sign Up for more than one Local buddie account or Sign Up for an account on behalf of any user other than yourself;
  • impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;
  • Use false claims, information or automated scripts to gather information from any User or the Local buddie Platform;
  • Accept or make a payment for one of the Local buddie Accommodations outside of Local buddie. If you decide to do so, you agree that you (a) would be in violation of these Terms and Conditions, (b) accept all responsibility and risks connected with such payment, and (c) hold Local buddie harmless from all liability for such payment;
  • Offer, any Accommodation on the name of Local buddie.
  • Violate, breach or infringe these Terms and Conditions and/or encourage or assist any User in doing so;
  • Post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances;
  • Engage in disruptive, circumventive, abusive or harassing behavior in any area or aspect of the Local buddie Platform;
  • Systematically retrieve data or other content from the Local buddie Platform to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise;
  • Use, display, mirror or frame the Local buddie Platform or Content, or any individual element within the Local buddie Platform Content, Local buddie name, any Local buddie trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page in the Local buddie Platform , without Local buddie express written consent;
  • Access, tamper with, or use non-public areas of the Local buddie Platform , Local buddie computer systems, or the technical delivery systems of Local buddie providers and/or vendors;
  • Attempt to probe, scan, or test the vulnerability of any Local buddie system or network or breach any security or authentication measures;
  • Avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Local buddie or any of Local buddie providers or any other third party (including another user) to protect the Local buddie Platform or Content;
  • Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Local buddie Platform or Content.

Local buddie reserves the right to prosecute any breach or violation of this Local buddie Acceptable Use Policy to the entire extent of the law. You also accept that Local buddie has the right to take a range of actions against you, including, but not limited to cancelling, removing, blocking, deactivating, disabling the content of your account and your access to information and services on the Local buddie Platform.

 

 

13     Reporting Misconduct

 

If you stay at the Accommodation and you feel that someone is acting or has acted inappropriately, or unlawfully, including anyone who:

  • displays offensive, violent or sexually inappropriate behaviour,
  • you suspect is stealing from you,
  • engages in any other disturbing behaviour, or
  • violates any Section of this Terms and Conditions

You should immediately report such person to the Local Buddie Manager or immediately write it to us at support@localbuddie.com.

 

14     Complaint Management policy

 

This section outlines the Local Buddie policy on complaints and the procedures to be followed if a Student(s) cannot reach a resolution between themselves, should a problem in accommodation occur. Local Buddie’s response to complaints between will be based on a fair and efficient resolution, and at the first available opportunity. Please note the procedure below may vary slightly, depending on whether the complaint is raised by a Student, Local Buddie manager and/or any third party

 

When investigating a complaint, the number of people who know of the matter should be kept to a minimum. Only those directly involved e.g. Student (s) and a Local buddie manager and staff member should be informed in the first instance. Every person who becomes aware of the alleged complaint has a duty to maintain confidentiality and should be made aware of this.

 

Complaints and their investigation should be carried out in good faith. Students involved in a complaint should not be motivated by malice or ill will. The Local Buddie manager & staff members investigating the complaint should be fair and thorough, limiting his or her investigation to matters of relevance to the complaint and adhering to the confidentiality principle, while acting in good faith.

 

There are at least two perspectives to a complaint and the opportunity to present both needs to be provided. This needs to be done without prejudging, forming conclusions without all the facts, or predetermining any outcomes.

 

At all stages of the complaint process the Students are entitled to have a support person present. A Students may prefer an interpreter or friend whose English is at a higher level than their own. The support person is not an advocate and should not advocate on behalf of the Students. Similarly, if Local Buddie is more comfortable with a support person then this must be allowed.

 

Confidential records will be kept of all conversations, telephone calls and meetings, and will be used if the complaint becomes formal. Notes will be documented in the files all Students involved in the complaint. Notes should include the following:

 

·       Who was present

·       When the meeting took place

·       What was discussed

·       The outcome of the Meeting

·       The actions taken

 

 

 

Methods of Resolution:

 

Informal:

The preferred method of complaint resolution is informal, where appropriate.

Informal complaint resolution processes can be effective. They are voluntary, confidential, are conducted with goodwill, involve the minimal number of people and allow the parties to explore options and make their own decisions about how to resolve a complaint rather than having a ‘third party’ making and enforcing a decision.

Informal processes are not about blaming or finding fault; they are about attempting to resolve the complaint. In many instances informality encourages both Student and/or Student(s) and/or Local Buddie to be more honest and to feel that they do not have to defend or justify themselves as they would have to in a more formal investigation process.

Local Buddie Manager & a staff member will assist in solving a problem when it is bought to the attention of the local office. If satisfaction is not reached after discussion with the Local Buddie Manager & a staff member, the problem can be escalated to the Local Buddie State Manager and then to the Local Buddie CEO.

Formal:

Where informal resolution does not satisfy the Student(s) and the grounds and context of the complaint require further investigation, a formal process will be instigated if this is what the complainant requests. Upon request Local Buddie staff will provide a Complaint Report Form for the complainant to complete and return to Local Buddie for further investigation.

Local Buddie take any complaints regarding harassment, bullying or discrimination very seriously.

 

Definitions

Harassment may be sexual in nature or based on gender, race, disability or sexual preference. It includes behaviour that intimidates, offends, degrades or humiliates.

Discrimination occurs when a person is treated less favourably than another person because of certain attributes (direct discrimination), or when a requirement that is the same for everyone has an unfair effect on some people because of an attribute, such as race, gender or disability (indirect discrimination).

Bullying behaviour is described as the repeated less favourable treatment of a person by another or others, which may be considered unreasonable and inappropriate practice. It includes behaviour that intimidates, offends, degrades or humiliates.

Procedure:

A. Record as much information as possible, including:

  • Who the allegations are against
  • What the alleged behaviour is
  • When the alleged behaviour occurred
  • Where it occurred
  • How the parties both felt and how it affected them
  • How the parties wants to proceed with the complaint
  • What each party wants as an outcome of the complaint process and how this might be achieved
  • Check if there is an immediate need to make interim changes to reduce the continuing impact of the situation, e.g. the re-allocation of the Student

B. Discuss the complaint with a fair, non-judgmental attitude

C. Assist the Student(s) to evaluate their options and choose a strategy for addressing the issue

D. Ensure record of the information in A)is obtained from the corresponding party

E. Attempt to resolve the complaint with the parties concerned

F. Clarify appropriate standards of behaviour

G. Escalate if necessary

 

Local Buddie will ensure that a complaint is dealt with as quickly as possible 

It is important that, whatever the outcome, Student understand what the outcome is, how it was reached and what is expected of them.

The outcomes should include:

  • A guarantee that any offending behaviour will stop
  • An assurance that reprisals for making the complaint, or retribution for having offended, will not be tolerated
  • An agreed path forward, which takes into account the specific needs and feelings of each individual involved
  • A procedure for monitoring the situation so that each individual will feel supported and protected

Appeals

Students  should request the assistance of the Local Buddie  Manager or the Local buddie CEO if no resolution is able to be reached. Full written justification of the appeal will need to be provided.

Where the Student remain dissatisfied with the outcome of an appeal process or a grievance process, the Student may lodge a complaint with

  • The Justice Department
  • The Ombudsman in each State

 

 

15     COVID 19 Safety policy & Covid Survey

 

COVID-19 is an infectious disease caused by a newly-discovered virus that emerged in late 2019. Most people infected with the COVID-19 virus will experience mild to moderate respiratory illness and recover without requiring hospitalisation. Older people, and those with underlying medical problems, are more likely to develop serious illness.

 

Several safe and effective vaccines have been developed to prevent people from getting seriously ill from COVID-19.

 

Vaccination is an important step for people to protect themselves and the community against the virus. Local Buddie encourages all students , staff members , vendors , agents to receive an approved COVID-19 vaccination if it is considered safe for you to do so on the advice of a health practitioner.

 

International students travelling to Australia will need to follow Australian Government health and border requirements, as well as guidelines from the state/territory government in which they will be studying.

 

As a general rule, anyone entering Australia must provide proof of COVID-19 vaccination/exemption and evidence of a negative COVID-19 Polymerase Chain Reaction (PCR) test taken within 3 days prior to their flight’s scheduled departure

 

 

It is mandatory for all students to update their COVID-19 vaccination double dose certificate information on Local Buddie Platform at least 4 days prior to the package start date. Local buddie reserves the right to terminate without compensation a Student’s package Booking if the Student will not upload COVID-19 vaccination double dose certificate at least 4 days prior to the package start date.

 

If a student is unwell and/or has been exposed to COVID-19 (through close contact or being in a hotspot) prior to the package start date, they will be required to postpone their arrival with immediate effect and inform Local Buddie Manager or write it to us at support@localbuddie.com within 6 hours from the time of detection of Covid 19. They will need to complete the Government mandated quarantine if ordered and provide a negative COVID test prior to use Local Buddie services. In this case , Local Buddie will have the final decision on all charges and refunds, and Local Buddie decision will be binding on the Student

 

If a student is unwell and/or has been exposed to COVID-19 (through close contact or being in a hotspot) post arriving into Australia and during the stay with Local Buddie. Local Buddie shall immediately transfer the student to an alternative accommodation to avoid putting other student at risk of contracting the virus. Student might have to pay extra charges for such transfers and all medical expenses shall be borne by the student on its own. Local Buddie will have the final decision on all charges and refunds, and Local Buddie decision will be binding on the Student.

 

All students must commit to COVID-safe practices to help safeguard the health and wellbeing of everyone in the Local Buddie.

 

16     Sexual Harassment and Abuse

 

Local Buddie prohibits sexual harassment or abuse of any Student under the care or supervision of Local buddie. Sexual abuse is defined as inappropriate sexual contact or interaction with a Student and/or Local buddie employee and/or it’s representative whether initiated or received, by any individual functioning as a Local buddie Manager, any other employee, Student , Student parent or Guardian or anyone exercising responsibility, for any aspect of the Student’s care. Sexual abuse includes sexual assault, exploitation, molestation or injury.

 

Any Local Buddie employee and /or its representative, student, student parent/guardian who suspects, witnesses or otherwise learns of any potential instance of sexual harassment or abuse must immediately report it to Local Buddie Manager and/or supervisor and such incidents shall be immediately reported to the local law enforcement agencies in respective Australian state as required by law. You can also contact any higher level manager within Local Buddie or send an email to support@localbuddie.com. Urgent matters shall be reported to local law enforcement immediately and then reported directly to the CEO of Local Buddie.

 

We take all allegations of sexual harassment or abuse extremely seriously. All complaints will be kept confidential to the extent possible, but confidentiality cannot be guaranteed.

 

If the alleged perpetrator is the student and/or student parent/guardian, the Student will be immediately removed from the home and shall be kept in alternate accommodation. All cost of this alternate accommodation shall be borne by the student only. This incident shall be immediately reported to the local law enforcement agencies in respective Australian state as required by law.

 

If the alleged perpetrator is an Local buddie staff member, we reserve the right to place the staff member on an involuntary leave of absence, or otherwise re-assign that person to responsibilities that do not involve personal contact with the alleged victim or other Students, during the course of an investigation. This incident shall be immediately reported to the local law enforcement agencies in respective Australian state as required by law.

 

Our legal obligation is to report suspected sexual harassment or abuse to appropriate authorities, we will endeavour to keep the identities of the alleged victims and investigation subject confidential.

 

Intentionally false or malicious accusations of sexual harassment or abuse, or intentionally providing false information in a related investigation, is also prohibited and will subject the offending individual to discipline, up to and including termination of the individual’s relationship with the organisation.

 

 

17     Other Conditions

 

17.1     All package price payment and other service payments ( if any) are received and paid in AUD ( Australian Dollars).

17.2     All student will staying in an accommodation on twin sharing basis unless and until approved by Local buddie.

17.3     The number of Students placed with one Local buddie home should be limited to maximum 8 student.

17.4     Students will not be placed in a Local Buddie home with another Student of the opposite gender.

17.5     Female Local Buddie Manager will always be assigned to local buddie home with Female Students.

17.6     No male student are allowed in the Female Local buddie home and no female student are allowed in     male Local buddie home.

17.7     If ‘special needs’ has been highlighted every care and precaution should be taken and confirmation sought from the Local buddie Manager that they can meet the Student’s requirement.

17.8     Students may request to be placed with a friend or a relative, or in the case of underage Students who may request to be placed with someone of their own culture or language background, where possible. The decision for this request shall be at the discretion of Local buddie.

17.9     Students shall be placed as close to their education institution as possible, but within 90 minutes by public transport at a maximum.

17.10  Students are to abide by curfews / Lockdown local government rules as set in each state.

17.11  All student shall always inform the Local Buddie manager if they are moving out of Local buddie home.

17.12  Local Buddie Shall not be responsible for any critical incident and/or emergency happens with Student. The clinical definition of an “Emergency” is defined as a serious, unexpected, and often dangerous situation requiring immediate action. The clinical definition of a “critical incident” is defined as an event that causes individuals to experience a strong emotional reaction that interferes with their usual coping skills.

17.13  The Student will be expected to

 

a)     to meet all personal expenses for travel, entertainment, telephone calls, medical expenses and other personal and incidental costs.

b)     respect and adhere to guidelines / rules for living in the Local Buddie Home and accommodation  as given by the Local Buddie which include conditions such as no smoking, no alcohol, spending no longer than 20 minutes in the shower and leaving the bathroom tidy.

c)     Smoking and consumption of alcohol are prohibited for all Students under 18 years of age.

d)     Consumption of illicit drugs is prohibited as per state laws.

e)     Offer to help with minor household chores such as washing up and keeping their bedroom clean and tidy

f)      Be considerate and keep noise to a minimum after 8.30pm

g)     If Students damage any property within the Local buddie home, they must report it immediately to their Local buddie Manager so replacement options can be discussed.

h)     Keep all valuables, money, passport and airline tickets in a safe place.

i)       Behave appropriately and be prepared to participate in reasonable Local buddie activities

j)       Respect and be aware that cultural differences and beliefs of the other student and Local buddie manager and other staff may differ from their own.

k)     File Covid Survey regularly on the Local buddie dashboard.

l)       Adhere to the guidelines set down by the Local buddie which may vary from accommodation to accommodation, for example, orientation for Students and other advice given about the Local buddie programme.

m)   Be aware and abide by the laws of Australia and the rules of your education institution.

 

 

18     User and Local Buddie content

 

18.1   Subject to your agreement with these Terms and Conditions, Local Buddie grants you a limited, nonexclusive, non-transferable license to view and access Content, solely for your personal and non-commercial use. You acknowledge and accept that you have no right to sublicense the license rights granted in this section. In addition, you agree not to copy, change, modify, adapt, adjust, or prepare any derivative works based on, distribute, transfer, sell, trade, display, share, transmit, broadcast or otherwise exploit the Site, Local Buddie Platform, Local Buddie Services or Content, except as expressly permitted by these Terms and Conditions or otherwise in writing by Local Buddie. You acknowledge that you are granted no license or rights by implication or otherwise under any intellectual property rights owned or controlled by Local Buddie or its licensors, except for the license and rights expressly granted in these Terms and Conditions.

18.2   Local Buddie may allow you, in our sole discretion, to post, share, publish or transmit User Content. By making your content available on the Local Buddie Platform, including advertising and promotional campaigns, you hereby grant Local Buddie a worldwide, perpetual, irrevocable, royalty-free, transferable, worldwide, nonexclusive license with the right to sublicense, to use, view, adapt, copy, share, distribute, transmit, broadcast, access, and otherwise exploit User Content for any and all purposes. Local Buddie does not claim any ownership rights to User Content, and you will continue to have rights to use, exploit and access your own User Content.

18.3   Users are solely responsible for all of their User Content that they make available on the Local Buddie Platform. Users represent and warrant that (a) they are sole owners of their entire User Content provided to Local Buddie or through the Local Buddie Platform, and have all rights, consents and releases that are necessary to grant Local Buddie the rights to utilize such User Content as provided in these Terms and Conditions; and (b) neither the User Content nor any of its publication, post, transmission, distribution, or uploading on the Local Buddie Platform or otherwise to Local Buddie will violate any third-party’s rights, including, but not limited to patent, copyright, trademark, secrets, morals, privacy, publicity, proprietary or intellectual property, or will result in violation of any law or regulation.

18.4   Students shall not transmit any material or information to the Local Buddie Platform that is false, libellous, defamatory, obscene, profane, solicitous, infringes on any copyright or other proprietary rights of any other person or entity, or otherwise could result in civil or criminal liability under the law.

 

19     Term, Termination and suspension of these Student Terms and conditions

A. These Terms and Conditions will be effective for a 30-day term, at the end of which it will automatically and continuously renew for subsequent 30-day terms until such time when you or Local Buddie terminate these Terms and Conditions in accordance with this Section.

B. You may terminate these Terms and Conditions at any time by sending us an email to Support@localbuddie.com. If you cancel your Local Buddie account as a Student, any unapproved package Booking Request and any approved Booking will be automatically cancelled as a Student cancellation and any refund will depend upon the terms of the Student Cancellation Policy.

C. Without limiting our rights specified below, Local Buddie may terminate these Terms and Condition for convenience at any time by giving you 30 days’ notice via email to your registered email address.

D. In addition, Local Buddie reserves the right to terminate these Terms and Conditions immediately and without notice if you have or are believed to have (i) materially breached or violated these Terms and Conditions or any policies or rules, (ii) provided incorrect, misleading, fraudulent, incomplete, or outdated information during the sign up process or at any time during your use of the Local Buddie Platform or your stay at an Accommodation, or (iii) violated any laws, policies, regulations or third party rights. Local Buddie also reserves the right to terminate these Terms and Conditions immediately and without notice if Local Buddie believes in good faith that such measures are reasonable and necessary to protect security, comfort or property of other Student and users , Local Buddie or third parties, or for purposes such as fraud prevention or activities, risk assessment, investigation or security. In the event that any such termination will take place, Local Buddie will use reasonable efforts to notify you of the termination.

E. Local Buddie also reserves the right, at its sole discretion to temporarily or permanently delay, limit, deactivate, suspend, or cancel any Package Booking Request, Booking, listing, account, Review or Content, as well as limit or deny access to the Local Buddie Platform, if (i) you have breached or violated these Terms and Conditions or any policies or rules (including house rules), (ii) you have received poor, negative or unfavourable reviews, or (iii) Local Buddie considers in good faith that such measures are reasonable and necessary to protect security, comfort or property of other Students and Users, Local Buddie or third parties, or for purposes such as fraud prevention or activities, risk assessment, investigation or security. In the event that any such action will take place, Local Buddie will use reasonable efforts to notify you of the action.

F. In case of non-material breaches and where applicable and at Local Buddie’s sole discretion, you may be given an opportunity to resolve the issue to Local Buddie’s reasonable satisfaction.

G. if we take any of the measures described above (i) we may retain 100% amounts you have paid and all confirmed package Bookings that have been cancelled, irrespective of pre existing cancellation policies, and (ii) you may not receive any refund for pending or confirmed Bookings that were cancelled.

H. In the event that the Student or Local Buddie terminates these Terms and Conditions, Local Buddie is under no obligation to remove, delete or return any User Content to the Student, including, but not limited to reviews, photographs, information, descriptions, messages, email communication. If these Terms and Conditions have been terminated, Students are not entitled to restore, use or access their User Content and/or account unless otherwise permitted by Local Buddie. In addition, Students are not permitted to use, access or attempt to use or access the Local Buddie  Platform, Local Buddie Services or any Local Buddie account through any other Local Buddie account.

I. If the Student or Local Buddie terminates these Terms and Conditions, then the clauses of these Terms and Conditions that reasonably should survive termination will remain in effect.

 

20     Copyright Policy

 

If you believe that any content uploaded or otherwise made available on the Local Buddie Platform infringes upon any copyright which you own or control, you may notify us with a written communication that contains substantially the following:

 

A)    Identify in sufficient detail the copyrighted work or intellectual property that you claim has been infringed so that we can locate the material. If multiple copyrighted works are covered by your notification, you may provide a representative list of such works.

B)    Identify the URL or other specific location on the Local buddie Platform that contains the material that you claim infringes your copyright described in Item A above. You must provide us with reasonably sufficient information to enable us to locate the alleged infringing material.

C)    Provide the electronic or physical signature of the owner of the copyright or a person authorized to act on the owner's behalf.

D)    Include a statement by you that you have a good faith belief that the information contained in your notice is accurate and that you attest under penalty of perjury that you are the copyright owner or that you are authorized to act on the copyright owner's behalf.

E)    Include your name, mailing address, telephone number and email address.

Please note that you may be liable for damages, including court costs and attorney's fees, if you materially misrepresent that content on the Local Buddie Platform is copyright infringing.

 

Upon receiving a proper notification of alleged copyright infringement, we will remove or disable access to the allegedly infringing material within 72 hours from the receipt of the legitimated claim.

 

Please note that if you materially misrepresent that the disabled or removed content was removed by mistake or misidentification, you may be liable for damages, including costs and attorney's fees. If you are unsure of whether you own all the necessary rights to the material that is the subject of the complaint, filing a claim to us may be inappropriate.

 

21     Disclaimers

 

A. If you choose to use the local buddie platform or content, you do so voluntarily and at your sole risk. the Local Buddie platform (including site, application and Local Buddie services), content and all other services and items are provided “as is”, without warranty or condition of any kind, either express or implied. without limiting the foregoing, Local Buddie expressly disclaims any warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade. Local Buddie makes no warranty that the Local Buddie platform (including site, application and Local Buddie services), content and all other services and items, including, but not limited to, any accommodations, will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Local Buddie makes no warranty regarding the quality of any accommodations, the services or content or the accuracy, timeliness, truthfulness, completeness or reliability of any content obtained through the Local Buddie platform.

 

B. You agree that you have had whatever opportunity you deem necessary to investigate the local buddie platform, local buddie services, laws, rules, or regulations that may be applicable to the services you are receiving and that you are not relying upon any statement of law or fact made by local buddie relating to an accommodation listing.

C. You acknowledge and agree that local buddie does not have an obligation to conduct background or registered sex offender checks on any user, including, but not limited to, students. If we choose to conduct identity verification or background checks on any user, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a student or guarantee that a students or other user will not engage in misconduct in the future.

D. You agree that some local buddie services may carry inherent risk, and by participating in such services, you choose to assume those risks voluntarily. For example, some local buddie services may carry risk of illness, bodily injury, disability, or death, and you freely and wilfully assume those risks by choosing to participate in those local buddie services. You assume full responsibility for the choices you make before, during and after your participation in a local buddie service.

E. No advice or information, whether oral or written, obtained from local buddie or through the local buddie platform or collective content, will create any warranty not expressly made herein.

F. You are solely responsible for all of your communications and interactions with other users of the local buddie platform and with other persons with whom you communicate or interact as a result of your use of the local buddie platform, including, but not limited to, any students. Local buddie makes no representations or warranties as to the conduct of users of the local buddie platform or their compatibility with any current or future users of the local buddie platform. You agree to take reasonable precautions in all communications and interactions with other users of the local buddie platform and with other persons with whom you communicate or interact as a result of your use of the local buddie platform, including, but not limited to, other students, particularly if you decide to meet offline or in person, and regardless of whether such meetings are organized by Local Buddie. Local buddie explicitly disclaims all liability for any act or omission of any student, host or other third party.

G. The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights. However, the duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by law.

 

22     Liability and indemnification

A. Limitation of liability. You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Local Buddie platform, your booking of any packages and accommodations through the Local Buddie platform, and any contact you have with other users, whether in person or online, remains with you. Neither Local Buddie nor any other party involved in creating, producing, or delivering the Local Buddie platform (including our licensors) or content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these terms and conditions, (ii) the use of or inability to use the Local Buddie platform or content, (iii) any communications, interactions or meetings with other users or other persons with whom you communicate or interact as a result of your use of the Local Buddie platform , in each case whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Local Buddie has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.

B. Indemnification. You agree to release, defend, indemnify, and hold Local Buddie and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of these Terms and Conditions or any Local Buddie policies or requirements, (ii) your access to or use of the Local Buddie Platform or Content; (iii) your User Content; (iv) your interaction with any User or other third party; (v) the use, condition or Booking of an Packages and Accommodation by you, including but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a Booking or use of an Accommodation; or (vi) your breach of any laws, rules, regulations or third party rights.

 

23     Feedback

 

Local Buddie welcomes and encourages you to provide feedback, comments and suggestions for improvements to the Local Buddie Platform (“Feedback“). You may submit Feedback by emailing Local Buddie at support@localbuddie.com or by other means of communication. Any Feedback you submit to Local Buddie will be considered non-confidential and non-proprietary to you. By submitting Feedback, you grant Local Buddie a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

 

24     Miscellaneous Provisions

A. Notices. Any notices or any communications allowed or required, including, but not limited to those concerning modifications of these Terms and Conditions, will be provided in writing either (i) via electronic mail or text message (to the email address or cell phone number provided on the Student’s Local Buddie profile), (ii) through Notification on the Dashboard of the Student’s Local Buddie account, or (iii) via entry or update to the Site. The date of the foregoing notice or communication will be considered the date on which such notice or communication is in effect, unless otherwise specified.

B. Severability. Should any provisions of these Terms and Conditions for any reason be declared invalid, void, or unenforceable by a court of competent jurisdiction, the validity and binding effect of any remaining portion will not be affected, which will remain in full force and effect, and the parties agree that the offending provisions shall be deemed modified and reformed to the minimum extent necessary to make them valid and enforceable.

C. Applicable Law. Students agrees and covenants that these Terms and Conditions and performance under these Terms and Conditions, and all proceedings that may ensue from its breach, be construed in accordance with and under the laws of the Victoria, Australia and that in any action, proceeding that may be brought arising out of, in connection with or by reason of these Terms and Conditions, the laws of the Victoria, Australia apply and shall govern to the exclusion of the law of any other forum. In the event of litigation, jurisdiction and venue shall be in Melbourne. Student hereby submit to the jurisdiction of the Melbourne Court.

D. Waiver. No waiver by either party of any provision of these Terms and Conditions shall be deemed a waiver of any other provision, and no course of conduct or failure or delay in enforcing the provisions of these Terms and Conditions shall affect the validity, binding effect, or enforceability of these Terms and Conditions.

E. Withholding Taxes. Local Buddie may, in its sole and absolute discretion, withhold from all compensation payable pursuant hereto all sums required to be withheld under federal, state and city laws, or governmental regulation or ruling.

F. Injunctive Relief. Nothing in these Terms and Conditions shall prevent Local Buddie from seeking injunctive or other equitable relief from a court of competent jurisdiction to enforce the provisions of these Terms and Conditions. The Student irrevocably consents to such injunctive relief.

G. Attorney's Fees. In the event of any controversy or dispute arising out of these Terms and Conditions, the prevailing party or parties will be entitled to recover from the non-prevailing party or parties, reasonable expenses, including, without limitation, attorneys’ fees and costs actually incurred.

H. Authority. Each party to these Terms and Conditions hereby represents and warrants that it has the legal power, right and authority to enter into and carry out these Terms and Conditions.

I. Further Documentation. Each party to these Terms and Conditions, without further consideration, agrees to execute and deliver such other documents and take such other action as may be necessary to consummate more effectively the subject matter hereof.

J. Third Party Beneficiaries. These Terms and Conditions are entered into for the sole benefit of Local Buddie and the Student and their respective permitted successors and assigns. No party other than Local Buddie and Student and such permitted successors and assigns shall have any right of action under or rights or remedies by reason of these Terms and Conditions.

K. Third Party Links and Resources. The Local Buddie Platform contains links to other Internet sites and resources that are not related to or controlled by Local Buddie. Local Buddie assumes no responsibility or liability for any errors or omissions in the materials or information available on or through such other Internet sites or resources. The existence of such links is not an endorsement by Local Buddie of such Internet sites or the resources, contents, or operators thereof. In addition, such other Internet sites and resources may provide less security than Local Buddie and have a privacy policy different than that of Local Buddie. Your access to and use of such Internet sites and resources is at your own risk.

L. Copyright Policy. Local Buddie honours and recognizes copyright law and expects all Students to comply as well. Local Buddie reserves the right to terminate any Student’s account who continuously violates or is believed to be continuously violating the rights of copyright owners.

M. Entire Agreement. Unless supplemented by a document referenced and integrated or by additional Local Buddie terms, guidelines, rules or policies, these Terms and Conditions, together will all Local Buddie policies and requirements referenced herein, compose the entire and full acknowledgment, acceptance and agreement between you and Local Buddie. These Terms and Conditions will supersede and replace any and all prior oral, written agreement between you and Local Buddie in relation to the Local Buddie Services, Accommodations, Packages, Bookings, and Content. Except where otherwise stated herein, these Terms and Conditions may not be modified or amended by oral agreement, but only by Local Buddie in its sole discretion.

N. Assignment. You may not assign or transfer these Terms and Conditions without written consent of Local Buddie. You recognize that if you attempt to transfer or assign these Terms and Conditions without Local Buddie consent, such transfer will be null and invalid. Local Buddie reserves the right to assign or transfer these Terms and Conditions at its sole discretion. These Terms and Conditions will inure and bind to the advantage and benefit of the parties, their successors and permitted assigns.

25     Dispute Resolutions and Arbitration process.

 

There are a number of mechanisms available to you to resolve any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability or with the services provided by a Third Party Provider (any "Dispute").

 

Local Buddie will operate this complaints process in a reasonable manner. You agree and acknowledge that you must raise any dispute with the Services or the services provided by Local buddie or Third Party Provider as soon as is practicable, but no later than 10 days from the end time of the service provided. If you fail to raise a dispute within 10 days from the end time of the service provided, Local Buddie shall be under no obligation to resolve such dispute and Local Buddie shall in its sole discretion choose whether or not to attempt resolution of the Dispute.

 

Local Buddie is committed to offering a consumer-friendly dispute resolution process. Therefore, a Student who wishes to bring a claim will participate in the following two-step dispute resolution process: first, an informal negotiation directly with Local Buddie, and second, binding arbitration administered by the arbitrator and shall be resolved by arbitration in accordance with the ACICA Arbitration Rules

 

To begin this dispute resolution process, Local Buddie and you agree to notify each other of such proceedings in writing. You must notify Local Buddie at support@localbuddie.com. Local Buddie will notify you at the most recent email address associated with your Local Buddie Platform account. First, informal negotiation will take place. If after such meeting and after a good faith effort to resolve the dispute, either party feels that the dispute cannot be resolved informally, the party who wishes to initiate formal arbitration process will notify the other in writing via email.

 

The seat of arbitration shall be Melbourne, Australia unless otherwise agreed mutually between student and Local buddie. The law governing this Arbitration Agreement shall be the substantive law that applies in the seat of the arbitration.

 

Your use of our platform, these terms, our Privacy Policy and all of our legal terms and notices will be governed by and construed in accordance with the laws of Victoria, Australia and by using our platform you irrevocably and unconditionally submit to the jurisdiction of the courts of that State

 

Any proceedings, including documents and briefs submitted by the parties, correspondence from a mediator, and correspondence, order and awards issued by an arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless:

 

(i)              The disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and

(ii)             The third party agrees unconditionally in writing to be bound by the confidentiality obligation set out in these Terms.
